Chennai Corporation Commissioner Non-Committal on Budget being made Public

Satta Panchayat Iyakkam, Today gave in-person representation to both the Chief Electoral Office and Corporation Commissioner. 

Our Secretary, Mahesh Kumar and member Jagadeesh, today met the Deputy Secretary to The Chief Electoral Officer , Public (Elections) Department and gave the representation in-person which was sent via email yesterday regarding media reports that the Budget is being withheld because of the Election Code of conduct. The Deputy Secretary Ms.Anne Joseph, said "they have not received any communication from the Chennai Corporation on the same and they will do the needful on the receipt of the same". She also clarified that the code of conduct does not prevent the budget being published. 

We also gave the representation to Chennai Corporation Commissioner and Special Officer Dr. D. Karthikeyan I.A.S. The commissioner said the work is in-progress and they will publish the same, but was non-committal on when the budget will be made public. We requested the commission to make it public at the earliest. 

We also like to point that while the model code of conduct came effect on March 12, It didnot prevent the State Government from publishing the budget on March 16. So we see no reason why the budget reportedly been passed on March 14, cant be published to the public. The undue delay raises query if something is fishy with the budget. The commissioner now playing the role of Special Officer in the absence of Mayor and an elected council is directly responsible to the public and we hope he will immediately do the needful and make the budget public.

வெளிப்படைத்தன்மை வேண்டும்....

முந்தைய ஆண்டுகளில் ஆசிரியர் தகுதி தேர்வு(TET) எழுதியவர்களிலிருந்து பணிநியமனம் செய்யப்படுவது குறித்தான தெளிவான கொள்கை முடிவை அரசு அறிவிக்க வேண்டும் – 2012ல் TET தேர்வெழுதி தகுதிபெற்று காத்திருக்கும் 500 தேர்வர்களுக்கு முன்னுரிமை தந்து பணிநியமனம் செய்யப்படவேண்டும்.

2012 ம் ஆண்டு அக்டோபர் மாதம், தமிழ்நாடு ஆசிரியர் தேர்வு வாரியம் நடத்திய ஆசிரியர் தகுதி தேர்வில் (பிற்சேர்க்கை) வெற்றி பெற்றும், இது நாள் வரையில் பணியமர்த்தப்படாமல் இருக்கும் 500 தேர்வர்களுக்கு(இடை நிலை ஆசிரியர்கள்) முன்னுரிமை தந்து உடனடியாக பணியாணை வழங்க தமிழக அரசை சட்டப் பஞ்சாயத்து இயக்கம் வலியுறுத்துகிறது.

 

ஆசிரியர்கள் நியமனத்தில், வேலைவாய்ப்பு அலுவலகங்களில் பதிவு செய்தவர்களை பணிமூப்பு அடிப்படையில் நியமிக்கும் நடைமுறை முன்னர் தமிழக அரசால் பின்பற்றப்பட்டு வந்தது. "கல்வி உரிமை சட்டம்" இயற்றப்பட்ட பின்னர், ஆசிரியர் தகுதி தேர்வு முறை நடைமுறைப்படுத்தப்பட்டது. 2012 ம் ஆண்டு முதல் ஆசிரியர் தகுதி தேர்வில் பெறும் மதிப்பெண்களை வைத்தே தரவரிசை வெளியிடப்பட்டது.

 

 

 

 

இந்நிலையில் 2013 ம் ஆண்டு  முதல் மதிப்பு முறையை (வெயிட்டேஜ்) அமல்படுத்தி அதனடிப்படையில் தரவரிசை வெளியிடப்பட வேண்டுமென தமிழக அரசு ஆணையிட்டது. அவ்வாணையின்படி ஆசிரியர் தகுதி தேர்வில் பெறும் மதிப்பெண்களுக்கு 60 விழுக்காடு மதிப்பும், DTEd or DEEd உள்ளிட்ட தேர்வுகளில் பெறும் மதிப்பெண்களுக்கு 25 விழுக்காடு மதிப்பும் மற்றும் பள்ளி மேல்நிலைத் தேர்வுகளில் பெறும் மதிப்பெண்களுக்கு 15 விழுக்காடு மதிப்பும் என புதிய மதிப்பு முறையில் கணக்கிடப்பட்டு தரவரிசை தயாரிக்கப்படுமென அறிவிக்கப்பட்டது.

2012 ம் ஆண்டு ஆசிரியர் தகுதி தேர்வின் முதல்தாளினை எழுதிய தேர்வர்கள்(இடைநிலை ஆசிரியர் பணியிடங்களுக்காக), தங்களின் DTEd / DEEd தேர்வுகளை தொடர்ந்து கொண்டிருந்த நிலையில், அவர்களின் கல்வி நிறைவு சான்றிதழ்கள் 2013 ம் ஆண்டு சமர்ப்பிக்கப்பட்ட பிறகே, அவர்களுக்கு ஆசிரியர் தகுதி தேர்வில் தேர்ச்சியடைந்ததற்கான தகுதிச் சான்றிதழ்கள் வழங்கப்பட்டன.  2012 ம் ஆண்டு பணி நியமனம் பெற்றவர்களை காட்டிலும், தகுதியானவர்களாகவும் திறமையானவர்களாகவும் இருந்தும், தேர்வெழுதிய பின்னர் விதிமுறைகள் இடையில் மாற்றப்பட்டதால்  இவர்களுக்கு இன்னமும் பணிநியமனம் வழங்கப்படவில்லை.

 

2013 ம் ஆண்டு ஆசிரியர் தகுதி தேர்வெழுதிய தேர்வர்களோடு சேர்த்து, புதிய மதிப்பீடு முறையில் தரவரிசை நிர்ணயம் செய்யப்பட்டதே இவர்கள் பாதிக்கப்பட்டதற்குக் காரணம். தேர்வெழுதிய போது நடைமுறையில் இல்லாத விதிகள், பின்னர் இடையில் பின்பற்றப்பட்டது என்பது நியாயமற்ற செயலாகும். இந்தப் பிரச்சனைகளுக்கும் கூடுதலாக, பாதிக்கப்பட்டவர்கள் உரிய விளக்கம் பெற மாவட்ட / மாநில கல்வித் துறை அலுவலகங்களை ஒவ்வொரு முறை அணுகியபோதும் அவமதிக்கப்பட்டும் அலட்சியப்படுத்தப்பட்டும் உள்ளனர்.

 

மேலும் ஒன்று முதல் ஐந்தாம் வகுப்பு வரையிலான பிரிவில் உள்ள வேலைவாய்ப்பு மற்றும் காலிப் பணியிடங்கள் குறித்து விவரங்கள் அறிவிக்கப்படவுமில்லை, நேரில் விசாரித்த போது  உரிய பதிலும் தரப்படவில்லை. இதன் காரணமாக 2012 ம் ஆண்டு பிற்சேர்க்கை தேர்வெழுதிய தேர்வர்கள் மிகுந்த மனஉளைச்சலில் உள்ளனர். அதுமட்டுமில்லாது தேர்ச்சியடைந்த தேர்வர்களின் தகுதிச் சான்றிதழ்கள், ஏழு ஆண்டுகளுக்கு அதாவது 2019 ம் ஆண்டு வரை மட்டுமே  செல்லத்தக்கது என்பதனால் மேலும் கவலையடைந்துள்ளனர்.

 

 

கூடுதலாக தமிழ்நாடு ஆசிரியர் தேர்வு வாரியம், 2017 ம் ஆண்டுக்கான ஆசிரியர் தகுதி தேர்வினை வரும் ஏப்ரல் மாதம் 29 மற்றும் 30 தேதிகளில் நடத்தவுள்ள நிலையில் அத்தேர்வில் பத்து லட்சத்துக்கும் அதிகமானவர்கள் பங்கு பெறுவார் என எதிர்பார்க்கப் படுகிறது.     

 

2012 ம் ஆண்டு தேர்வெழுதி தேர்ச்சியடைந்து ஆண்டுக்கணக்கில் காத்திருக்கும் தேர்வர்களை உடனடியாக பணியிலமர்த்தும் திட்டத்தினை தமிழக அரசு அறிவிக்க வேண்டும் எனவும், காலிப் பணியிடங்களை நிரப்புவதற்கான அறிவிப்புகளை வெளியிடாமலிருப்பது எதேச்சதிகாரமானது. எனவே, தமிழக அரசு இந்த விஷயத்தில் உடனடியாக தலையிட்டு துரித நடவடிக்கை எடுக்க வேண்டும் எனவும், 2012 ம் ஆண்டு தேர்வெழுதி தேர்ச்சியடைந்து வேலை கிடைக்காமல் இருக்கும் பாதிக்கப்பட்டவர்களுக்கு நீதி கிடைக்க வழிவகை செய்யவேண்டும்.

 

ஆசிரியர் தகுதித்தேர்வு நியமனங்களில், 2012 தேர்வர்களுக்கு மட்டுமல்லாமல் அதன் பின்னர் தேர்வெழுதி தகுதி பெற்ற தேர்வர்களுக்கும் நீதி வழங்க வேண்டும். தகுதியின் அடிப்படையில், முன்னுரிமை அடிப்படையில் அவர்களுக்கு பணிநியமனம் வழங்கவேண்டும் என கேட்டுக்கொள்கிறோம்.

 

இவ்விஷயத்தில் அரசு, உரிய கவனம் செலுத்தாவிடில் பாதிக்கப்பட்டவர்களைத் திரட்டி  நீதி கேட்டுப் போராட்டம் நடத்துவோம் என்றும் தமிழக அரசானது ஆசிரியர் நியமனத்தில் வெளிப்படையான கொள்கை முடிவை அறிவிக்க வலியுறுத்தி நீதிமன்றத்தில் வழக்கு தொடர்வோம் என்றும் தெரிவித்துக்கொள்கிறோம்.

d)            Pass such other and further order or orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.

Odisha Yog Mahotsav to take place in Bhubaneshwar from 24-26th March

As a build-up to the International Yoga Day on June 21st, the Ministry of Ayush has partnered with the Art of Living, to organise a series of three-day 'Yoga Utsavs' across various state capitals to take Yoga to the masses. The Department of Yogic Science at Sri Sri University, founded by Gurudev Sri Sri Ravi Shankar, will be hosting the Odisha Yog Mahotsav at Bhubaneshwar's Janata Maidan from the 24th to 26th of March.

The 3 day fun-filled festival will showcase the multifaceted discipline of Yoga through dance, music and food apart from yoga and meditation. Several organisations including the Art of Living, the Brahmakumaris, Patanjali Yog Peeth, Chinmaya Mission, North Odisha University, K.B. College and AYOS will be taking seminars, yoga, pranayama and meditation sessions at the Yog Mahotsav.

With something for everybody, competitions for children and young adults, yoga with a live band, yogathon challenge, ayurvedic cooking classes and special seminars, the event promises to be a complete package. You could learn yogic diet cooking in Mitahar, or attend Shikhar, the youth conference on Yoga and immerse yourself in Ananda, an evening of cultural performances by celebrated artists such as Prachee Shah Pandya, an acclaimed actor and Kathak dancer and flutist Srinibas Sathpathy.

In a wonderful initiative by the Social Security & Empowerment of Persons with Disabilities Department (SSEPD) of the Government of Odisha, they will ensure that Yoga also reaches the elderly, the differently abled, the transgender community and those battling addictions. The event will feature several interesting sessions such as 'Yoga for Addicts,' 'Yoga beyond Gender' and 'Yoga for Management of Stress among adolescents.' The organizers believe that the Yog Mahotsav is going to be a great leveler, serving to augment and propagate the classical knowledge of Yoga and its benefits to the masses at large.

Ms. Pramila Nath, one of the organizers said that the objective of the event is to take the science of handling the mind and emotions to the people at large. "The Mahotsav is called 'Yoga beyond the body', because it's not just about asanas. Yoga is about all the techniques and the knowledge that help bring a balance in one's mind and body. We want everyone, irrespective of religion, community, age and gender to experience this holistic knowledge that brings peace and balance to our lives," she implored.

Sub:  Prohibit V.K.Sasikala, a convict  to function as General Secretary of AIADMK  - Also prohibit all the convicted who are holding as key office bearer positions in registered political parties all over India

Ref:  Our representation dated 28-12-2016 regarding the same subject (Attached)

From various orders of Election commission of India (ECI) and Supreme Court(SC) of India, we strongly believe that ECI and SC are against criminalization of politics.

About 20 years back Election commission of India passed an order(ECI No. 509/Disqln./97 - J.S.I Dated :28-08-1997) with the following lines,

"...... Subject: Criminalisation of Politics - participation of criminals in the electoral process ascandidates - disqualification on conviction for offences - effect of appeal and bail- regarding.

Whereas, the country is facing the serious problem of criminalisation of politics in which criminals, i.e., persons convicted by courts of law for certain offences, are entering intoelection fray and contesting as candidates"

 

 

Likewise, Supreme court of India in its Landmark Judgement ( Delivered by justices A K Patnaik and S J Mukhopadhaya on 10-08-2013)  has struck down a section of Representation of the People Act that allows a convicted lawmaker to remain in office while there are still cases pending against them.

"….The only question is about the vires of section 8(4) of the Representation of the People Act (RPA) and we hold that it is ultra vires and that the disqualification takes place from the date of conviction" , the Judgement says.

Having said that, we would like to bring to your attention about a case of CRIMINILAISATION of POLITICS in Tamilnadu.  

J.Jayalalitha , the long time General Secretary of AIADMK and Ex.Chief minister of Tamilnadu  passed away on 05-12-2016.  On 29-12-2016 , V.K.Sasikala was appointed/nominated as General Secretary of AIADMK.

Meanwhile, on 14-02-2017 Judgment was pronounced with regard to Disproportionate Asset case(DA Case). As per the judgement,  V.K.Sasikaa, a convict in  DA case (A2 in the case where A1 was Ex.Chief Minister of Tamilnadu J.Jayalalitha)  is serving her 4 year sentence in Bengaluru Jail.

The appointment/nomination of V.K.Sasikala as General Secretary is being disputed by a faction of leaders in AIADMK(citing the non adherence of bye-laws prescribed in party constitution)  . Regarding this, a representation was given to ECI  by AIADMK  MP's.  The issue is pending with ECI.

In this background, we would like to seek your immediate attention about our representation sent to you on 28-12-2016.  Our representation seeks ECI's intervention to ensure convicted criminals are barred from holding key office bearer posts like General Secretary / President of any registered political party..

In Tamilnadu, AIADMK is the ruling party.  As of now, V.K.Sasikala claims to be the General Secretary of AIADMK. Being a General Secretary of the party, she indirectly controls the functioning of the Tamilnadu Government.

For example,  on 28-02-2017 a group of four senior ministers holding key positions in the Tamilnadu government  met V.K.Sasikala in Bengalur jail where she is serving her sentence.  Forest Minister C Sreenivasan, Cooperation Minister K Raju, School Education Minister K A Sengottaiyan and Food Minister R Kamaraj are the ministers who met her ( Indian Express Newspaper report dated 01-03-2017  is attached ). These kind of meeting will continue to happen in future. These kind of meetings by ministers raise the doubt that  V.K.Sasikala, the General Secretary of AIADMK running the Tamilnadu Government even though she is behind bars. 

There are many chances for V.K.Sasikala to give directions to ministers regarding  Government .schemes. We wonder, how  a convicted person can run the party ?  All these are happening because of her being General Secretary of the Party. That's why, in our representation dated 28-12-2016, we have asked Election Commission of India to intervene and ensure that convicted person cannot hold key office bearer position like General Secretary and President.

Election commission orders and Supreme court Judgement refers to the disqualification of  MLA's and MP's. But the spirit of the Judgement is about to stop "Criminalization of Politics" . There is a loophole in the Representation of People Act, where there is no direct prohibiting feature for convicted persons holding key positions in the party. Particularly when the convicted is a ruling party leader, then he/she gets a chance to run the Government indirectly. Kindly look into this and pass necessary orders to arrest the loophole.

As an immediate action, kindly announce that V.K.Sasikala cannot continue to be the General Secretary of AIADMK. Bye-election for  R.K.Nagar Constituency in Tamilnadu is going to happen on 12-04-2017. Last date for filing nomination is 23-02-2017. Please ensure that a V.K.Sasikala, a convict should not sign in the Form-A,Form-B for the AIADMK candidates.

Your announcement regarding this will set precedence and will make a huge impact all over the country. It may be a landmark action/order from ECI against "Criminalization of Politics".

Sir,  here is reproduce of the last paragraph of the Judgement given by supreme court on 14-02-2017 ( with regard to Disproportionate Asset case Judgement against J.Jayalalitha, V.K.Sasikala and 2 others)

"8. Every citizen has to be a partner in this sacrosanct mission, if we aspire for a stable, just and ideal social order as envisioned by our forefathers and fondly cherished by thenumerous self-effacing crusaders of a free and independent Bharat, pledging their countless sacrifices and selfless commitments for such cause." ( Page 569, CRIMINAL APPEAL NOS. 300-319 OF 201)

As said in Judgement We, Satta Panchayat Iyakkam a movement for "Good Governance" particularly fighting against corruption proposing this very needed order/amendment to stop "Criminalaisation of Politics".  We expect, Election Commission will also play its role to be a partner in this "sacrosanct mission" against CORRUPTION and will pass necessary orders.
