கிரிமினல் வழக்குகளில் இரண்டு ஆண்டுகளுக்கு மேல் தண்டனை பெற்றவர்கள் சட்டமன்ற, பாராளுமன்ற தேர்தலில் போட்டியிட முடியாது என மக்கள் பிரதிநிதித்துவ சட்டம் (பிரிவு 8(3)) கூறுகிறது. அதே போல, ஏற்கனவே சட்டமன்ற, பாராளுமன்ற உறுப்பினர்களாக தேர்ந்தெடுக்கப்பட்டவர்கள் குற்ற வழக்குகளில் தண்டிக்கப்பட்டால் உடனடியாக தங்களது பதவியை இழக்கும் வண்ணம் கடந்த 2013- ம்ஆண்டு உச்சநீதிமன்றம் தீர்ப்பளித்தது. இத்தகைய தகுதியிழந்த நபர்கள் ஆறு வருடங்களுக்கு தேர்தலில் போட்டியிட தடையும் விதிக்கப்பட்டுள்ளது.
இதன் அடிப்படையிலேயே மறைந்த தமிழக முதல்வர் ஜெயலலிதா, ராஷ்ட்ரிய ஜனதா தளம் கட்சியின் தலைவரும் அப்போதைய பிகார் முதல்வருமான திரு.லாலு பிரசாத் யாதவ், திமுகவை சேர்ந்த ராஜ்யசபா உறுப்பினர் செல்வகணபதி போன்றோர் தமது பதவியை இழந்தனர். இதில் ஜெயலலிதா மட்டும் பின்னர் கர்நாடக உயர்நீதிமன்றத்தால் விடுவிக்கப்பட்டதால், மீண்டும் முதல்வரானார்.
தண்டனை பெற்ற ஆட்சியாளர்கள், அரசியல்வாதிகள் இவ்வாறு தேர்தலில் போட்டியிட தடை விதிக்கப்படுவதால், ஜனநாயகத்தின் மீது மக்களுக்கு நம்பிக்கை ஏற்படுகிறது; சட்டத்தின் ஆட்சி எனும் தத்துவத்தை வலுப்படுத்துகிறது. ஆட்சியாளர்களும் ஊழல் செய்ய தயங்கும் சூழலை இது ஏற்படுத்தியுள்ளது. அதே சமயம், இவ்வாறு தகுதி நீக்கம் பெற்ற அரசியல் தலைவர்கள், தத்தமது பதவியை இழந்தாலும் தொடர்ந்து கட்சியில் முக்கிய பங்காற்றி வருகின்றனர்.
உதாரணமாக, தகுதி நீக்கத்தில் இருக்கும் லாலு பிரசாத் யாதவ் தற்போதும் அக்கட்சியின் தலைவராக செயலாற்றி வருகிறார். தண்டனை காலத்தில் இருந்தபோது ஜெயலலிதாவும், அக்கட்சியின் செயல்பாடுகள் மற்றும் அரசின் செயல்பாடுகளை மேற்கொண்டு வந்தார் என்பது அனைவரும் அறிந்ததே. இம்மாதிரியான செயல்கள் நேர்மையான ஊழலற்ற ஆட்சி எனும் கோட்பாட்டிற்கே எதிரானது என சட்ட பஞ்சாயத்து இயக்கம் கருதுகிறது.
· சட்டமன்ற, நாடாளுமன்ற தேர்தலில் போட்டியிட தகுதியில்லாத ஒருவர், தன் கட்சியின் சட்டமன்ற, நாடாளுமன்ற உறுப்பினர்களை வழிநடத்துவது எந்த வகையில் நியாயம்?
· தேர்தலில் போட்டியிட தகுதி இழந்த ஒருவர் மக்கள் பிரதிநிதித்துவ சட்டப்படி பதிவுசெய்யப்பட்ட, அங்கீகரிக்கப்பட்ட கட்சியை தலைமையேற்று எப்படி வழி நடத்த முடியும்?
· எந்த காரணத்திற்காக அவர் தண்டிக்கப்பட்டாரோ, அதையே தனது தண்டனை காலத்திலும் அவர் செய்வதற்கான சூழ்நிலையை ஏன் ஏற்படுத்தித்தர வேண்டும்?
சட்டமன்ற, நாடாளுமன்ற தேர்தலில் போட்டியிட தகுதியிழந்த ஒருவர், கட்சியில் தலைமை பொறுப்பில் இருந்துகொண்டு தனது கட்சியில் உள்ள சட்டமன்ற, பாராளுன்மன்ற உறுப்பினர்களை கட்டுப்படுத்துவது சட்ட மீறலே. எனவே நேர்மையான ஆட்சியை ஏற்படுத்தவும், குற்றவாளிகளை அரசியலில் இருந்து வெளியேற்றவும், இந்திய தேர்தல் ஆணையம் இரண்டு ஆண்டுகளுக்கு மேல் தண்டனை பெற்றவர்களை மக்கள் பிரதிநிதித்துவச் சட்டப்படி பதிவுசெய்யப்பட்ட கட்சிகளின் உறுப்பினராகவும், பொறுப்பாளராகவும், தலைமை பொறுப்பை ஏற்கவும் தடை விதிக்கும் வகையில் உரிய சட்ட திருத்தம் கொண்டுவர இந்திய தேர்தல் ஆணையத்தை சட்ட பஞ்சாயத்து இயக்கம் கேட்டுக்கொள்கிறது.
இது குறித்து சட்ட பஞ்சாயத்து இயக்கம் இந்திய தேர்தல் ஆணையத்திற்கு மனு அனுப்பியுள்ளது.

PRESS RELEASE (28.12.2016)
Representation of People act 1951(Section 8(3)) prohibits the convicts sentenced to imprisonment for more than 2 years in criminal cases from contesting in Assembly and Parliamentary elections for 6 years. Apart from that, a supreme court judgment was delivered in 2013(July10th) that convicted representatives (MLAs and MPs) will be disqualified from their elected posts immediately after the pronouncement of conviction. Based on this judgment former Chief Minister of Tamil Nadu Ms. J. Jayalalithaa, former Chief Minister of Bihar Mr. Lalu Prasad Yadav, DMK Rajya Sabha member Mr. Selvaganapathy had lost their posts. However Ms. Jayalalithaa was acquitted by Karnataka high court and was reinstated as Chief Minister of Tamilnadu.
These kinds of rulings establish faith in democracy. And they act as a deterrent for MLAs / MPs to involve in corruption. But, unfortunately these rules and judgement does not prevent them from holding key posts in their party and thereby controlling the administration in an indirect manner. For example, Mr. Lalu Prasad Yadav who was disqualified(Sep 2013) is currently the President of Rashtriya Janata Dal party. Even when serving the sentence Ms. Jayalalithaa controlled her party's activities and supervised the functioning of the government via her position as General Secretary. Satta Panchayat Iyakkam is of the opinion that these kind of activities undermine the idea of honest and corruption-free governance.
i. How can a person who is disqualified to contest in elections be allowed to control the elected representatives(MLAs,MPs) of their party?
ii. How can a person who is disqualified to contest in elections be allowed to head a party registered/recognized based on Representation of People act 1951?
Allowing the convict to control the government indirectly is against the spirit of Supreme court judgment and Representation of people act 1951.It doesn't make any sense to just have the person disqualified for namesake i.e barring only from holding constitutional posts.
To ensure corruption free Governance and criminals becoming leaders of political Satta Panchayat Iyakkam demands the Election Commission of India to take necessary steps to amend the Representation of People Act 1951 and relevant acts to prohibit convicts sentenced to imprisonment for more than 2 years from becoming members or office-bearers in political parties.
